Terms of Use

These Terms of Use apply to the use of the Oriental Motor (Europa) GmbH (hereinafter referred to as "Oriental Motor") website (orientalmotor.eu including subdomains).

Article 1 (Definitions)

In these Terms of Use, the terms listed in the following items shall have the following meanings.
The term "website user" refers to anyone who accesses the Oriental Motor’s website, including registered website users.
The term "registered website user" refers to a website user who has completed the registration process in accordance with the provisions of Article 4.
The "services" refers to the services provided by Oriental Motor to users of Oriental Motor's website in accordance with these Terms of Use, and the content and types of services may be changed, increased or decreased at any time at the sole discretion of Oriental Motor.

Article 2 (Scope of Terms of Use and amendments)

  1. These Terms of Use shall apply to the Oriental Motor and website users with respect to the use of this service, and website users shall faithfully comply with these Terms of Use when using the Oriental Motor website.
  2. The individual regulations that Oriental Motor separately posts on the Oriental Motor website or stipulates by other means, and the additional regulations that the Oriental Motor notifies on the website from time to time, constitute a part of these Terms of Use. If there is any difference between these Terms of Use and individual rules and additional rules, individual rules and additional rules shall take precedence.
  3. Oriental Motor may amend these Terms of Use at its discretion, and the amended Terms of Use shall take effect from the effective date determined by Oriental Motor at its discretion.
  4. In the case of the preceding paragraph, Oriental Motor will notify website users of changes to the Terms of Use and the effective date within a reasonable time, at least 2 weeks prior to the effective date. However, Oriental Motor may shorten the period if we determine that the degree of disadvantage to the user, due to the change is minor.
  5. The provisions of the preceding paragraph shall not apply in cases where changes to these Terms of Use are compatible with the general interests of the users.
  6. Oriental Motor shall not be held responsible for any losses or damages incurred by website users as a result of changes to the Terms of Use.

Article 3 (Restrictions on website users)

Website users shall not perform any of the following acts.

  1. Use of the Oriental Motor website by methods other than those specified by the Oriental Motor website.
  2. Use of the Service by impersonating another person.
  3. Unauthorised modification of the information provided on the Oriental Motor website.
  4. Unauthorised access to data stored on computers using the Oriental Motor website, and acts that may destroy or damage this data.
  5. Acts that interfere with the operation of this service.
  6. Business or commercial activities using this Service.
  7. Collecting the personal information of other website users.
  8. Actions that violate these Terms of Use, actions that are offensive to public order and morals, and other actions that violate domestic and international laws.

Article 4 (User registration)

Some services require you to register as a "registered website user." Customers who wish to register (hereinafter referred to as "registration applicants") should apply for registration as a "registered website user" according to the procedures prescribed by Oriental Motor, and according on the content of the service required. When Oriental Motor has accepted your application for registration, your registration process will be completed. Oriental Motor may not approve the registration of a registration applicant if the registration applicant falls under any of the reasons set forth below.

  1. If the registration applicant does not exist.
  2. If the registration applicant is subject to suspension or revocation of registered website user status, and falls under any of the reasons for suspension or revocation.

Article 5 (Changes of reported matters)

  1. If there are any changes to the information provided to Oriental Motor at the time of registration, the registered website user must notify Oriental Motor of such changes without delay through the prescribed procedures.
  2. In the event that a registered website user of the website neglects to notify Oriental Motor as described in the preceding paragraph, Oriental Motor shall not be held responsible for any failure to deliver, or delay in delivery of notifications, purchases, etc. from Oriental Motor.

Article 6 (Management of login ID and password)

  1. Please use the e-mail address used when registering as your login ID. The management and use of the login ID and password registered by the registered website user, are the responsibility of the registered website user. Oriental Motor shall not be liable for any damages resulting from negligence in the management, or use of this website by registered website users.
  2. Registered website users may not transfer their login ID and password to a third party, or allow a third party to use. Even in the event that a third party uses your login ID or password to conduct a transaction with Oriental Motor, the registered website user accepts liability.

Article 7 (Handling of registration information)

The registered website user agrees that information reported to Oriental Motor at the time of applying for registration, or subsequent changes in registration information, as well as matters related to this service, will be recorded in Oriental Motor’s database.
Oriental Motor shall use this information in accordance with the "Privacy Policy."

Article 8 (Method of notification to website users)

Notices from Oriental Motor to website users shall be sent by general posting on the Oriental Motor website, by e-mail to the e-mail address provided to Oriental Motor by registered website users, or by any other method deemed appropriate by Oriental Motor. Oriental Motor shall not be responsible for any undelivered or delayed notifications.

Article 9 (Suspension or cancellation of registered website user status)

In the event that a registered website user falls under any of the following reasons, or any of the reasons in Article 3, Oriental Motor may suspend or revoke the registered website user status without any prior notice or demand. However, even if the status as a registered website user is revoked, the user is not exempted from the responsibility of fulfilling the obligations that have already been incurred through the use of this service.

  1. Unauthorised acquisition or use of a login ID or password.
  2. If the registered personal information is false and is not corrected promptly.
  3. If Oriental Motor deems you to be an unsuitable registered website user.

Article 10 (Handling of links)

If you wish to link to our website, please contact any of Oriental Motor’s sales offices, or the "Contact us via e-mail form" on Oriental Motor’s website.
However, the Oriental Motor reserves the right to change URLs and content without notice.

Article 11 (Copyright)

  1. The copyrights and other rights to the programs and data posted on the Oriental Motor’s website belong to Oriental Motor, and Oriental Motor does not transfer these rights to website users. Copyright(C) ORIENTALMOTOR Co., Ltd. All Rights Reserved.
  2. The programs and data on Oriental Motor’s website are licensed for use within the organization of the website user for non-commercial purposes, and the duplication, modification, sale, distribution, transfer, or lending of programs or data beyond the scope of this license is prohibited.

Article 12 (Disclaimer)

  1. Oriental Motor assumes no responsibility for whether or not applications, notices, orders, or other information sent by registered website users will arrive at the computer system of Oriental Motor website, or whether or not the information that arrives at the computer system of Oriental Motor website is identical to the information sent by registered website users.
  2. Oriental Motor shall not be liable for any damages incurred by website users or third parties in connection with the provision, delay, modification, interruption, suspension, cessation, or abolition of this service or any other service. In addition, Oriental Motor may suspend, discontinue, or change the provision of this service without any notice to registered website users.
  3. Oriental Motor does not guarantee the programs and data on the Oriental Motor website in any way. In no event shall Oriental Motor be liable for any direct or indirect damages incurred by website users as a result of the use of such programs or data.
  4. The specifications of our products are subject to change without individual notice to website users, and the data on the Oriental Motor website may not match actual products.
  5. Oriental Motor assumes no responsibility whatsoever for external links.

Article 14 (Compensation for damages)

  1. In the event that a website user causes damage to a third party through the use of this service, the website user shall resolve the issue at their own risk and expense, and shall not cause any damage to Oriental Motor.
  2. In the event that a website user violates these Terms of Use, or causes damage to Oriental Motor due to fraudulent or illegal activities, Oriental Motor shall be entitled to claim reasonable compensation for damages from said website user.

Article 15 (Affiliated services)

  1. When website users use services (hereinafter referred to as "partner services") provided by third parties affiliated with Oriental Motor (hereinafter referred to as "partners"), they shall comply with the terms of use stipulated by the partners in addition to these Terms of Use.
  2. Oriental Motor shall not be responsible for any affiliated services.

The Terms of Use come into force on 1 February 2025.
