4. Data collection on our website

Cookies

In some instances, this website uses cookies. Cookies do not harm your computer and do not contain viruses. Cookies serve to make our website more user-friendly, effective and secure. Cookies are small text files which are placed on your computer and stored by your browser.

Most of the cookies we use are "session cookies". These are deleted automatically at the end of your visit. Other cookies remain stored on your device until you delete them. These cookies enable us to recognise your browser the next time you visit us.

You can set your web browser to inform you about the use of cookies and only allow cookies on a case-by-case basis, to prevent cookies in particular cases or in general, and to automatically delete cookies when closing the web browser. Disabling cookies may restrict the functionality of this website.

Cookies that are required to carry out the electronic communication process or to provide certain functions that you wish to use (e.g. shopping cart function) are stored on the basis of Article 6(1)(f) of the GDPR. The website operator has a legitimate interest in storing cookies, in order to optimise this website and ensure it can be reliably provided. In so far as other cookies (e.g. cookies for analysing your surfing behaviour) are stored, these are covered separately in this privacy notice.

Server log files

The website provider automatically collects and stores information in server log files, which your browser transmits to us automatically. These are:

  • - Browser type and browser version
  • - Operating system used
  • - Referrer URL
  • - Time of the server request
  • - IP address

This data is not merged with data from any other data sources.

The lawful basis for processing the data is Article 6(1)(f) of the GDPR. Our legitimate interest stems from the purpose for data collection, i.e. system security and stability.

Contact form

If you send us enquiries via our contact form, your details from the enquiry are stored by us, including the contact details provided by you, for the purpose of processing your enquiry and in the case of follow-up questions. We will not share this data without your consent.

The data entered on the contact form are therefore processed exclusively on the basis of your consent (Article 6(1)(a) of the GDPR). You can revoke this consent at any time. An informal message to us by email is sufficient. The legality of data processing operations which occurred prior to consent being revoked remains unaffected by the revocation.

The data entered by you on the contact form will remain with us until you ask us to delete it, you revoke your consent to us storing it or the purpose for the data being stored no longer exists (e.g. after your request has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

User registration

For certain web services, such as downloading CAD data, user registration is required. This is done using the double opt-in procedure. The data collected is stored for user verification when using the web services and will not be passed on to third parties without consent.

The data processing is carried out exclusively on the basis of your consent (Art. 6 para. 1 lit. a GDPR). You can revoke this consent at any time and independently delete the user account or instruct us by e-mail to delete it. The legality of the data processing operations carried out until the revocation remains unaffected by the revocation.

We will store the data you entered during user registration until you delete it yourself, request us to delete it, revoke your consent to storage or the purpose for data storage no longer applies (e.g. if you no longer wish to be registered as a user of web services). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Processing of data (customer and contract data)

We collect, process and use personal data only to the extent necessary for the justification, structural formulation or amendment of the legal relationship (inventory data). This occurs on the basis of Article 6(1)(b) of the GDPR, which allows data to be processed for the performance of a contract or pre-contractual measures. We collect, process and use personal data concerning the use of our websites (usage data) only in so far as is required to enable the user to use the service or be charged for it.

The collected customer data is deleted upon completion of the order or termination of the business relationship. Statutory retention periods remain unaffected.

Data transmission upon the conclusion of a contract for online shops, retailers and the shipment of goods

We transmit personal data to third parties only if this is necessary within the scope of executing the contract, i.e. to the company entrusted with shipping the goods or the credit institution commissioned with processing the payment. Further transmission of data only occurs if you have expressly consented to this transmission. Your data is not disclosed to any third parties, such as for advertising purposes, without your express consent.

The basis for data processing is Article 6(1)(b) of the GDPR, which allows data to be processed for the performance of a contract or pre-contractual measures.

Cookie Consent Tool from Usercentrics (Usercentrics Cookiebot)

The recipient of your data within the meaning of Art. 13 (1) (e) GDPR is Usercentrics A/S. As part of order processing, Oriental Motor transmits personal data (consent data) to Usercentrics A/S, Havnegade 39, 1058 Copenhagen, Denmark, as processor. Consent data means the following data:

  • - Date and time of the visit
  • - Consent or refusal
  • - IP address
  • - Browser information
  • - End device information

Usercentrics stores a cookie in your browser in order to be able to assign the consents given or their revocation to you. The data collected in this way is stored until you ask us to delete it, delete the Usercentrics cookie yourself or the purpose for storing the data no longer applies. Mandatory statutory retention obligations remain unaffected.

The data is processed for the purpose of compliance with legal obligations (obligation to provide evidence pursuant to Art. 7 para. 1 GDPR) and the associated documentation of consent and thus on the basis of Art. 6 para. 1 lit. c) GDPR. Local storage is used to store the data. The consent data is stored for 1 year. The data is stored in the European Union. Further information on the data collected and contact options can be found at https://www.cookiebot.com/en/privacy-policy/.

We have concluded an order processing contract with Usercentrics, in which we oblige Usercentrics to protect our customers' data and not to pass it on to third parties.

Google reCAPTCHA

We use ‘Google reCAPTCHA’ (hereinafter ‘reCAPTCHA’) on this website. The provider is Google Ireland Limited (‘Google’), Gordon House, Barrow Street, Dublin 4, Ireland.

The purpose of reCAPTCHA is to check whether data entered on this website (e.g. on a contact form) is being done by a person or by an automated programme. To do this, reCAPTCHA analyses the behaviour of the website visitor based on various characteristics. This analysis begins automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, time spent on the website by the visitor or mouse movements made by the user). The data collected during the analysis is forwarded to Google.

The reCAPTCHA analyses run completely in the background. Website visitors are not notified that an analysis is taking place.

The data is stored and analysed on the basis of Art. 6 Sect. 1 lit. f GDPR. The website operator has a legitimate interest in protecting the operator's web offerings against abusive automated spying and against SPAM. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 (1) point a GDPR and Art. 25 (1) TDDDG, insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) within the meaning of the TDDDG. The consent can be revoked at any time.

For more information about Google reCAPTCHA, please refer to the Google Privacy Policy and the Google Terms of Use at the following links: https://policies.google.com/privacy?hl=en and https://policies.google.com/terms?hl=en.

The company is certified in accordance with the EU-US Data Privacy Framework (DPF). The DPF is an agreement between the European Union and the United States to ensure compliance with European data protection standards when processing data in the United States. Each DPF-certified company is obliged to comply with these data protection standards. Further information is available from the provider at the following link: https://www.dataprivacyframework.gov/participant/5780.

5. Analysis tools and advertising

Google Analytics

This website uses functions of the web analysis service, Google Analytics. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google Analytics uses cookies. These are text files which are stored on your computer and enable your use of the website to be analysed. The information regarding your use of this website, which is generated using the cookie, are usually transferred to a Google server in USA and stored there.

Google Analytics cookies are stored on the basis of Article 6(1)(f) of the GDPR. The website operator has a legitimate interest in analysing user behaviour in order to optimise both its website and its advertising.

IP anonymisation

We have activated the IP anonymisation function on this website. As a result, your IP address will be truncated by Google within the Member States of the European Union or in other states which are parties to the Agreement on the European Economic Area prior to transmission to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and then truncated. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports about the website activities and to provide other services relating to the use of the website and the services associated with the use of the website to the website operator. The IP address provided by your browser as part of Google Analytics will not be merged with any other data from Google.

Browser Plugin

You can prevent cookies from being stored by modifying the settings in your browser software; however, please be aware that if you do this you may not be able to use all the features of this website to the fullest extent possible. In addition, you may prevent Google from collecting and processing the data generated by the cookie relating to your use of the website (incl. your IP address) by downloading and installing the browser plugin available at: https://tools.google.com/dlpage/gaoptout?hl=en-GB.

Objection to data collection

You can prevent data from being collected by Google Analytics by clicking the following link. An opt-out cookie will be placed to prevent your data from being collected on future visits to this website: Disable Google Analytics.

More information on how data is handled by Google Analytics can be found in Google's privacy notice: https://support.google.com/analytics/answer/6004245?hl=en.

Order data processing

We have concluded an order data processing contract and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Demographic characteristics in Google Analytics

This website uses the "demographic characteristics" function of Google Analytics. This allows reports to be generated containing statements regarding the age, gender and interests of site users. These data are drawn from interest-related advertising by Google as well as user data from third-party providers. These data cannot be traced back to any specific person. You may disable this function at any time via the ad settings in your Google account or generally prohibit the collection of your data by Google Analytics as outlined under "Objection to data collection".

Google AdWords and Google Conversion Tracking

This website uses Google AdWords. AdWords is an online advertising program from Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ("Google").

We use Conversion Tracking as part of Google AdWords. When you click on an ad provided by Google, a cookie is placed for Conversion Tracking. Cookies are small text files that the web browser stores on the user's computer. These cookies expire after 30 days and are not used to personally identify the user. If the user visits certain pages of this website and the cookie has not yet expired, Google and we can recognise that the user has clicked on the ad and has been redirected to this website.

Each Google AdWords client receives a different cookie. The cookies cannot be tracked from the websites of AdWords clients. The information collected using the conversion cookies serves to generate conversion statistics for AdWords clients who have opted for Conversion Tracking. The clients are told how many users have clicked on their ad and been redirected to a website with a Conversion Tracking tag. However, they do not receive any information which can be used to identify users. If you would prefer not to participate in tracking, you can opt out of this by simply disabling the Google Conversion Tracking cookie via the user settings in your web browser. You will not be included in the Conversion Tracking statistics.

Conversion cookies are stored on the basis of Article 6(1)(f) of the GDPR. The website operator has a legitimate interest in analysing user behaviour in order to optimise both its website and its advertising.

More information on Google AdWords and Google Conversion Tracking can be found in Google's privacy policy: https://policies.google.com/privacy?hl=en&gl=en.

You can set your web browser to inform you about the use of cookies and only allow cookies on a case-by-case basis, to prevent cookies in particular cases or in general, and to automatically delete cookies when closing the web browser. Disabling cookies may restrict the functionality of this website.

Newsletter data

If you would like to receive the newsletter offered on our website, we will need an email address from you together with information that enables us to verify that you are the owner of that email address, and that you agree to receive the newsletter. Additional data is only collected on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.

The data provided on the newsletter registration form is processed exclusively on the basis of your consent (Article 6(1)(a) of the GDPR). Your consent to the storage of data, the email address and their use for sending the newsletter may be revoked at any time, by clicking "unsubscribe" in the newsletter. The legality of data already processed remains unaffected by the revocation.

The data given to us by you for the purpose of the newsletter subscription will be stored by us until you cancel your subscription and deleted by us once the newsletter subscription is cancelled. Data stored by us for other purposes remain unaffected.

Rapidmail

This website uses Rapidmail for sending newsletters. The provider is rapidmail GmbH, Augustinerplatz 2, 79098 Freiburg im Breisgau, Germany.

If you do not want analysis by Rapidmail, you must unsubscribe from the newsletter. An unsubscribe link can be found in every newsletter message. You can also unsubscribe from the newsletter directly on our website.

Data analysis using Rapidmail

For the purpose of analysis, emails sent with Rapidmail contain a "tracking pixel", which connects to the Rapidmail servers when the email is opened. This determines whether a newsletter message has been opened.

Furthermore, we can use Rapidmail to determine which links, if any, in the newsletter message have been clicked. All links in the email are tracking links, which allow your clicks to be counted.

More information on the analysis functions of Rapidmail can be found at: https://de.rapidmail.wiki/kategorien/statistiken/

Lawful basis

Data is processed on the basis of your consent (Article 6(1)(a) of the GDPR). You can revoke this consent at any time. The legality of data already processed remains unaffected by the revocation.

Storage period

The data given to us by you for the purpose of the newsletter subscription will be stored by us until you cancel your subscription and, once the newsletter subscription is cancelled, deleted by us, including from our servers, and also from the Rapidmail servers. Data stored by us for other purposes (e.g. email addresses for the members area) remain unaffected.

For more information, refer to Rapidmail's data privacy notice: https://www.rapidmail.de/datensicherheit.

We use Vimeo to present our online content in an appealing manner. This constitutes a legitimate interest as defined in Art. 6 Sect. 1 lit. f GDPR. If a corresponding agreement has been requested, the processing takes place exclusively on the basis of Art. 6 para. 1 lit. a GDPR; the agreement can be revoked at any time.
